Exhibit C supported Claim for default in payment by Loh Meng Chong Stanley & Loh Hui Xin Cheryl

For

  • March & April (two months before);
  • May (month of payment default by Respondent);
  • June (one month after).

For the month of May, there was no cash deposit in Claimant’s UOB account corresponding to Respondent’s (Cheryl Loh) tuition fees. There were corresponding deposits for the months of March and April.

Note, also, the lateness in payment by Mr Stanley Loh in March and April, compared to the other students.

* Sometimes, the cash were not deposited on the same day of receipt. There were practical reasons, e.g. inconvenient timing with lessons ending near 10pm with no cash-deposit machines nearby.

 

* The amount collected and the amount deposited were not a perfect match. There were practical reasons, e.g. a cash-deposit machine that refused to accept particular pieces of bank notes, requiring a later attempt; some “floating” cash (well less than $100) from the few cash withdrawals I made from my own account.

 

Supporting evidences attached:

  1. March to June records of communications (SMSes, WhatsApp) with parents of two other students (“Mrs Kathy Low – Deborah P5 Maths” and “ZiFei Mother”) who pay in cash.
  2. March to June receipts for cash received from “Mrs Kathy Low – Deborah P5 Maths” and “ZiFei Mother”.
  3. March to June UOB bank statements of Claimant showing corresponding cash deposits. There was no deposit for Respondent’s tuition fees for the month of May 2018.

 

March 2018

March – Deborah – $400. In WhatsApp message on 01 March, Mother of student offered to pay for all the 4 lessons in March when Claimant only intended to check with her for time of lesson on the next day (02 March). Payment in cash received on Fri 02 March.

 

 

 

 

 

 

 

 

 

 

 

March – ZiFei – $735. Invoice for March’s fees sent on Sat 03 March by SMS. Payment in cash received on 3 March.

 

April 2018

April- Deborah – $400. Invoice sent on Thu 5 April by WhatsApp. Payment in cash received on Fri 6 April.

 

April – ZiFei – $735. Invoice for April’s fees sent on Tue 10 April by SMS. Payment in cash received on Sat 14 April.

 

May – Deborah – $400. Mother of student took initiative to inform payment of tuition fees for May before April ended. Payment in cash received on Fri 27 April.

May – ZiFei – $840. Invoice for May’s tuition fees sent on Sat 05 May by SMS. Payment in cash received on Sat 05 May.

June 2018

June – Deborah – $400. Scheduling and offer to pay by Mother via WhatsApp message on 26 May. Payment in cash received on Fri 01 June.

June – ZiFei – $945. Invoice for June’s tuition fees sent on Sat 02 June by SMS. Payment in cash received on Sat 02 June.
